A revocable living trust is a legal document you create during your lifetime that holds title to your assets. Instead of owning your home or bank accounts in your own name, those assets are retitled into the trust’s name, with you as the trustee. You stay in complete control. You can amend the trust, add or remove assets, or revoke it entirely at any point while you are alive and have legal capacity.

Here is how the trust avoids probate: Florida courts only have jurisdiction over certain assets that are titled in your personal name at death. When your home, accounts, and investments are already titled to the trust, they fall outside your probate estate entirely.

Note: Some assets — like life insurance policies with a named beneficiary or property held jointly with survivorship rights — may also pass outside of probate without a trust.

Is a Trust Different from a Will? Do I Need Both?

They serve different purposes. A will takes effect only after death and must go through probate court. Can I change my trust after I sign it?
